Rules of Procedure of the Disciplinary Board



Article 1 General Provisions

1. The Rules of Procedure of the GMBS Disciplinary Board (hereinafter referred to as the "Rules of Procedure") are internal regulations of the GMBS that set out the Rules of Procedure of the GMBS Disciplinary Board.

Article 2 Convening a Meeting of the Disciplinary Board

  1. A meeting of the Disciplinary Board shall be convened by the chairman of the GMBS Disciplinary Board on the initiative of the Rector of the GMBS.

  2. A student whose alleged disciplinary offence is to be discussed at a meeting of the Disciplinary Board must be served with a summons to attend the meeting of the Disciplinary Board at least two (2) weeks before the date set for the meeting of the Disciplinary Board. The summons shall be sent to the student by e-mail or otherwise in writing.

Article 3 Meeting of the Disciplinary Board

  1. The meeting of the Disciplinary Board shall be chaired by the chairman of the Disciplinary Board or his/her deputy. The meeting of the Disciplinary Board shall not be in public.

  2. A quorum of the Disciplinary Board shall be present if a majority of all members is present.

  3. The GMBS student present whose alleged disciplinary offence is being heard has the right to comment on the circumstances under which the disciplinary offence occurred.

Article 4 Voting by the Disciplinary Board

  1. The Disciplinary Board shall decide on the proposed disciplinary measure by a public vote in the absence of the student whose alleged disciplinary offence is being discussed by the Committee.

  2. In the event of a tie for and against a proposal to impose a disciplinary measure, the vote of the chairman of the Disciplinary Board shall prevail; in the absence of the chairman, the vote of his/her deputy in charge of the meeting of the Disciplinary Board shall prevail.
  3. If any member of the Disciplinary Board requests a secret vote, the request shall be granted and the vote on the proposed disciplinary measure shall be secret.

  4. In the event of a tie for and against a proposal in a secret vote for the imposition of a disciplinary measure, the chairman of the Disciplinary Board, or in the absence of the chairman, the deputy in charge of the meeting of the Disciplinary Board, shall decide.
